Hearing Loss Workers’ Compensation in San Diego
Focused Representation for Workplace Hearing Loss
Work-related hearing loss can develop over years in a loud workplace or result from a specific incident. Kiwan & Chambers APC focuses solely on workers’ compensation cases, including claims that require medical evidence connecting hearing impairment to working conditions.
Attorney John G. Kiwan founded our firm in 1988. We serve injured workers throughout San Diego and Southern California in English and Spanish. Our contingency fee arrangement means we don’t get paid until the client is paid.

When Workplace Hearing Loss May Qualify for Benefits
California Labor Code §3208 defines an injury as an injury or disease arising out of employment. The statute also identifies hearing aids among the devices that may fall within workers’ compensation coverage.
Section 3208.1 recognizes both specific and cumulative injuries. A specific injury results from one incident or exposure, while cumulative trauma develops through repetitive harmful activity over time. Gradual noise-induced hearing loss is generally treated as cumulative trauma.
A claim may involve partial hearing loss or more severe impairment. Eligibility depends on the medical findings and evidence that employment caused or contributed to the condition.

Evidence Connecting Hearing Loss to Employment
An occupational hearing loss case requires more than a worker’s description of difficulty hearing. We research the employment circumstances and develop evidence connecting the injury to the worker’s job.
Evidence may address:
- Workplace sound levels: The type, intensity, and duration of loud conditions encountered at work.
- Audiogram findings: An audiogram measures hearing thresholds and records the extent and pattern of hearing loss.
- Medical causation: Medical opinions evaluate whether workplace conditions caused or contributed to the impairment.
Age, Prior Conditions & Apportionment:
Insurers may argue that age or a preexisting condition accounts for some or all of the impairment. Apportionment assigns percentages of permanent disability to work-related and non-work causes. Under Labor Code §4663, it must be supported by a reasoned medical opinion rather than assumption alone.

Benefits for Accepted Hearing Loss Claims
California workers’ compensation coverage may include medical expenses, temporary disability payments, permanent disability payments, supplemental job displacement benefits, and death benefits. The benefits available depend on the accepted injury, medical evidence, work restrictions, and disability findings.
Authorized medical care may include evaluation by hearing specialists, related treatment, and hearing aids. Temporary disability benefits may apply when an accepted injury prevents a worker from performing the usual job for a qualifying period. Permanent disability benefits address lasting impairment, while supplemental job displacement benefits may apply when eligible workers can’t return to their usual employment.
What to Expect After You Contact Our Firm
During a free consultation or virtual meeting, we discuss when symptoms began, the worker’s employment history, loud working conditions, and any medical evaluation already completed. A claim generally requires notice to the employer, medical assessment, and evidence connecting the hearing condition to employment.
The claim process may include:
- Reviewing work history, exposure information, audiograms, and medical opinions.
- Monitoring the claims administrator’s investigation, which generally may take up to 90 days.
- Addressing disputes involving treatment authorization, disability findings, or medical causation.
- Preparing for a Qualified Medical Evaluator assessment or deposition when required in a disputed claim.
Required medical treatment must be authorized within one working day, and disability payments must begin within 14 days after knowledge of the injury when payment is owed. Whether those obligations apply depends on the circumstances.
If utilization review denies requested treatment, Independent Medical Review provides a way to challenge that medical decision. We can also examine competing medical opinions and disputes over whether the impairment resulted from work.
